These Terms of Service ("Terms") govern your use of the BrokerMule website, application, and SMS-based listing alert service (the "Service") operated by BrokerMule ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. The Service is intended for licensed real estate professionals and their authorized representatives. By registering, you represent that you hold any required real estate licenses in the jurisdictions where you operate.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep it current. You may not share your account with others or allow multiple agents to use a single subscription.

3. Client consent and compliance

You are solely responsible for obtaining all necessary consents from your buyers before adding their phone numbers and personal information to the Service. You represent that each buyer whose phone number you submit has agreed to receive SMS listing alerts from you via the Service, in compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and all other applicable laws and regulations.

You are responsible for the accuracy of client information you enter, for configuring appropriate search criteria, and for any messages sent on your behalf. BrokerMule is not a party to the relationship between you and your buyers.

4. Subscriptions and billing

The Service offers subscription plans with varying limits on the number of active buyers and SMS messages. Plan details and pricing are displayed on our pricing page. Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selection).

You can upgrade, downgrade, or cancel your subscription at any time. Changes take effect at the start of the next billing cycle. We do not offer refunds for partial billing periods except where required by law. If your payment fails, we may suspend the Service until payment is resolved.

5. Acceptable use

You agree not to:

Use the Service to send unsolicited or spam messages;
Add phone numbers without the owner's consent;
Use the Service for any unlawful, fraudulent, or abusive purpose;
Attempt to access, disrupt, or reverse-engineer the Service's systems;
Scrape, copy, or redistribute listing data in bulk;
Resell or sublicense access to the Service without our written permission.

6. Intellectual property

The Service, including its design, software, branding, and original content, is the property ofBrokerMule and is protected by intellectual property laws. Property listings displayed through the Service are sourced from third-party providers and remain the property of their respective owners. You may not use the Service's branding or content outside the scope of providing listing alerts to your buyers.

7. Third-party services

The Service integrates with third-party providers for SMS delivery (Twilio), property data (HasData, Zillow), and payment processing (Stripe). We are not responsible for the availability, accuracy, or conduct of these third-party services. Their terms and policies may also apply to your use of the Service.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that listings will be available, accurate, or current. We do not guarantee that SMS messages will be delivered successfully, as delivery depends on carrier networks and other factors outside our control. Property data is provided by third parties and may contain errors or omissions.

9. Limitation of liability

To the maximum extent permitted by law, BrokerMule shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service, including but not limited to loss of clients, lost commissions, or failure to identify suitable properties. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold BrokerMule harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your breach of applicable laws — including claims related to sending SMS messages without proper consent.

11. Termination

You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms, if your account is inactive for an extended period, or if we discontinue the Service. Upon termination, your right to use the Service ends, and we may delete your data in accordance with our retention policy.

12. Changes to these Terms

We may modify these Terms from time to time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the United States and the state in which BrokerMule is incorporated, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction.
